She didn’t necessarily report it. She could have gone to the health center. Plus With IU better chance she can stay anonymous.

Wouldn't she have to testify at some point during the panel hearing though? If not, then that would be another problem with the panel setup because Ellison wouldn't be able to face his accuser.

I obviously don't know the details the panel had access to, and maybe there was some convincing evidence given during the hearing. I don't know. My issue is with the system in general. Schools should have the right to investigate and punish students for conduct violations, but when the alleged violation is serious criminal behavior the local authorities should take over, imo.

As ridiculous as it sounds, I was always told that even a “yes” while drunk isn’t consent. So even if you both are drunk and agree, the girl can call rape the next day. I’m not by any means saying this is the case here or know if Ellison is guilty/innocent.

I do think, however, that in sexual assault cases you are guilty until proven innocent. Saw it happen to a guy that lived right next to me senior year and he got kicked out of school. Came out later that the girl just regretted her decision to have sex that night and it cost this guy everything.

Certain people believe the woman implicitly while others refuse to believe the woman regardless. It’s a two way street. False rape accusations happen at worst 10 percent of the time and that’s just with the cases brought forward.

They don’t have the burden of proof a court has which is why Ellison isn’t in jail. Yes she would have had to talk to the panel but they can compel that

Legally consent while drinking/drunk varies by state.

All I know is that I grew up in Indiana my whole life and was told this throughout high school and while at IU

Was it confirmed she was drunk? Was he drunk too? Or just there? I’m guessing at a party or something?

Doesn’t matter if he was drunk one bit if he did it

Which is another reason why I have a problem with it. The burden of proof should be pretty dang high to yank a kid's scholarship and kick him out of school. It's not prison, but it's still a life altering decision. If he did do it then he's getting what he deserves, if he didn't do it his life is basically ruined for a crime he didn't commit.

I want to adjust my prior comment to when each party has been drinking the law varies by states. When it's just a single person drinking I don't know the law. My apologies for the confusion.

As Joe already alluded he will have a new scholly next week and as Chris said the panel had more info.

No worries, man. I think we can all agree that the court system is deeply flawed when it comes to this and that there needs to be a better solution, I just don’t know what that is.

Read the freaking article.

"An Indiana University panel determined that football player Morgan Ellison sexually assaulted a fellow IU student while she slept and then used force to continue the assault when she woke up, IndyStar has learned."

You can't consent when you're asleep, blacked out or otherwise. He used force after she woke up. What about that screams "please represent IU on the gridiron?"

Like someone posted above, there are plenty of beautiful girls at willing that you don't need to force anyone. You can't consent when drinking or asleep, period.

After reading what Chris said and now this, sounds like he is getting off easy. I’m glad he won’t be representing IU anymore.

But that doesn’t fit the narrative that she was drunk and this is just a witch hunt to punish innocent athletes that we are all so used to

There's an easy solution. Don't put yourself in that situation, have friends that have your back to do the right thing, and at the end of the day "do the right thing." This is another reason why I was lucky to have gone to school after being in the military. Don't ruin your career, schooling, or whatever over a bad decision. I hope sports staffs and admin are briefing student athletes on this often.

Agree with this completely. And that advice should apply to women as well.

If she was sleeping then yea. He doesn’t need to be around. Look for him to be at Ohio State, Michigan State or an SEC school next year.

Guessing like a Miami (OH) or JUCO. He was solid but not that good. If he was? He would be worth the headache. He wasn’t. I would be very shocked if he ended up at any school you implied or listed.

Absolutely, you should have good wingmen and wing women. Thankfully, I had good friends that squashed my inebriated "great ideas." You should be having the time of your life in college but not at the detriment of others. I hope parents and IU admin are reminding students of this.

In the end, it boils down to being a good human being. That goes both ways to guys and gals.
