Because he would have lost. Even though the charges were dropped, the damage was already done according to his contract. Best to take the $4M and move on.

Per the Austin American Statesmen, the University of Texas has a “clause in the contract allows the university to terminate or suspend Beard with cause if "Any conduct (a) that the University administration reasonably determines is clearly unbecoming to a Head Coach and reflects poorly on the University, the Program, or The University of Texas System; or (b) resulting in a criminal charge being brought against Head Coach involving a felony, or any crime involving theft, dishonesty, or moral turpitude."

Yes. Until the next incident. Which with an alcoholic who apparently can become violent and unpredictable, is a near certainty. 

So you get past the initial onslaught and start winning. Things are rolling. Then the headline in the paper one day reads “Indiana University men’s basketball coach drives drunk, kills family of 4” or something catastrophic, and then has to be removed with everyone involved shouldering the blame. That, and that alone, is the reason I doubt such a hire would happen. The AD and president would be sticking their necks out.

If Beard were showing himself to be a different man… one who no longer drinks, spends his free time in therapy, doing Bible study and community service… and sustained that for at least a decade, I’d be more inclined to entertain the idea. But it appears he’s not doing anything of the sort and if you try to force conditions on him it’s doomed from the start. Yawn.

These are all questions I would want a private investigator to answer.

The board is really up in arms over a candidate that i don't think, along with wade, that iu even makes it down the list to. 

I would think beard would be at the end of the list, when they have whiffed on absolutely everybody else.

Pure process for you all:

"Not guilty/not charged" is very different than "innocent." No defendant has ever been deemed "innocent" in a criminal court.

People are not charged and cases are dropped for a variety of reasons, including but certainly not limited to 'they didn't do it.'
