HoosierAloha Posted February 16, 2019 Posted February 16, 2019 Well that just makes my blood boil all over again....Sent from my iPhone using BtownBanners mobile appThis doesn’t surprise me. I believe some on here have been all over this for awhile. I’m more shocked that coaches left evidence in text messages about it than it was happening. I guess they thought they were just up against the paper tiger NCAA and not the FBI. Sent from my iPad using BtownBanners mobile app Quote
Class of '66 Old Fart Posted February 25, 2019 Posted February 25, 2019 Preliminary notifications have been sent out to representatives of both Arizona basketball coach Sean Miller and LSU basketball coach Will Wade that they will be subpoenaed for the April 22 federal basketball corruption trial, multiple sources told Yahoo Sports. These notifications are essentially a courtesy to avoid a public spectacle for the coaches, like getting served in the midst of a game or a practice. This is how the chess match works: One's 5th Amendment rights allow individuals to not testify when that testimony could incriminate them. Sean Miller and Will Wade will have very good attorneys, who will not allow their clients to incriminate themselves under oath. However, the federal government can completely eliminate that right against self-incrimination by granting Wade and Miller testimonial immunity. This is usually done after an immunized "Queen for a Day" interview, during which the government issues immunity for the interview to get a sneak preview of the witness's information. Immunized court testimony cannot be used against them in a criminal matter, but can be used in an employment or regulatory proceeding (i.e.; by the NCAA or their university administration). And, if they lie under oath, including when immunized, they can be prosecuted for criminal perjury and that immunized testimony may then be used against them in its entirety. Are they boxed in? Maybe; if The prosecutors are willing to grant testimonial immunity, Their truthful testimony would ruin their careers, and They aren't willing to risk criminal perjury charges to save themselves. Class of '66 Old Fart Posted February 25, 2019 Posted February 25, 2019 And there is typically a public perception that if one exercises their 5th amendment rights it's because they have something to hide. Rightly or wrongly as that may be. Quote

Given what I know about the case, it seems that these two coaches are not subjects or targets, and therefore would be immunized and thereafter have no 5th amendment rights to exercise. lillurk 1 Quote

HoosierAloha Posted February 26, 2019 Posted February 26, 2019 But if they admitted something wouldn’t the NCAA basically have to consider thinking about pondering the possibility of slapping them on the wrist. It all depends on if they self reported. I’m sure they could admit it in court, not self report, and be just fine. Sent from my iPad using BtownBanners mobile app Quote

HoosierFan1994 Posted March 6, 2019 Posted March 6, 2019 Maybe this is old news but I saw Pat Forde tell a Louisville sports radio show that the NCAA is going to hammer Kansas Louisville and LSU. Also said he is surprised Mack took that job and the fact he got recruits. I’ll believe it when I see it but he’s been credible.Sent from my iPhone using BtownBanners IUsafety 1 Quote

It was commonly thought that UNC and Miami (football) would be severely punished. The cases against them appeared insurmountable but they both lawyered up and the spineless, worthless, incompetent NCAA did absolutely nothing to them (note to AD’s, including Glass....never, never, never admit anything). The recruits obviously do not think anything will happen. As of today Arizona’s 2019 class is ranked number 1 and Louisville’s is fifth. If that doesn’t teach the schools a lesson I don’t know what will...LOL. ElectricBoogaloo and HoosierAloha 2 Quote

It might be the best thing for cleaning up college basketball: LSU playing on the national stage with chants of "cheaters" along with lots of talk about how they suddenly got so good. It would definitely give the NCAA a black eye and might be the one thing that gets them to finally take cheating seriously. One can hope. MikeRoberts 1 Quote
