Charging a player with a crime for assault based on spitting is flat out idiotic. I assume before covid it wouldn't have been a big deal but with covid I'm sure that why it was handled that way. This is a team-university thing, not a cop thing It has been a few years since I have done anything in the criminal law sphere, but there is actually a charge for battery with bodily fluid, which would include spit. When I worked in a prosecutor's office almost ten years ago as an intern, it was a reoccurring charge that you would see. Quote

This is a team-university thing, not a cop thing I would adjust that slightly: They absolutely had a 'legit', statutorily-supported basis to charge. Whether discretion should have been used is a completely different matter, and I tend to agree with your conclusion on that one. Good policing for me would have been the officers meeting with the player and his coach, and letting him know that if there was ever another incident like that again he would be charged. Way better than sticking a misdemeanor criminal record on a very frustrated 19 year old who was being taunted by 16,000 people. Quote

You can pull up a criminal statute on almost anything (hey, let’s charge jaywalkers with a crime!). You don’t arrest and charge a college kid in a basketball game for spitting, you don’t screw with a kid’s life, with a criminal charge, over something like this. It’s exceptionally stupid, and an absolute abuse of “discretion.” The almost certain result is that no prosecutor will pursue this idiotic charge, but now the kid has an arrest record.
