Rabjphns reposted something interesting from a NY case that I think is extremely relevant given the judges remarks about the rules. No where in the rules does it state those that played a 4th year in 25 can’t play a 5th year in 26. Some injunctions have been won recently on this precedent. Hoping this is how Daley and Wyatt’s case goes. If you are on X give it a read.

Saw that too.  Definitely looks promising. 
 

Would love for the team to find out tomorrow so they can handle it accordingly

Thank you for posting.  It never works when I try to link from X.

If the judge rules based on this which was mentioned by the judge in closing comments, then I would think the outlook on Daley/Wyatt/Alexis is good.  NY is a state court so I guess the NCAA can appeal a federal court?  The NCAA is always shooting themselves in the foot.  These lawyers outmaneuver them at every turn.

This is why I feel good about a verdict coming in from Monroe County (admittedly I was skeptical before this came about).  They have no clue what they are doing and why they are doing it.  Especially because it has been brought up by more than 1 judge now you think they would have prepared an appropriate answer to this question.  Complete joke of an organization.

I would suggest that their attorneys have prepared the most viable answers available, but they don’t have much to work with.

You are right.  NCAA makes these decisions thoughtlessly to the lawsuits that will be brought against them from said decisions then put these attorneys in situations to give these types of answers.  They have won some injunctions recently (Tennessee and Ohio) which is why I was pessimistic about this one until the point was mentioned by the judge in Monroe County stating where in the rules does it state 2025 cannot have a 5th year.  If the NCAA and attorneys would do their due diligence on the 'rules' they come up with prior to announcing them maybe they could actually keep from getting sued and looking foolish in court.

Poor Niz is reading through it all... still need to understand what the next steps may be.  They're eligible for Northwestern though.  Hopefully any other steps are after the season is over and this issue is put to bed.

Update: My understanding is the NCAA will almost certainly appeal to the Indiana Court of Appeals.  The NCAA will ask for a stay pending the outcome of the appeal -- which would make them ineligible again probably for the whole year because the appeal hearing will be scheduled pretty far out into the future.  If the Court of Appeals doesn't grant a stay, they're probably good the whole season, as again, the appeal will probably be sometime pretty out into the future (like 2027).

So I guess this is down to what the Court of Appeals does on the stay ask from the NCAA.  This is a good first step today though.

NCAA just won a stay in another appeal but on a different type of ruling (had something to do with anti trust laws how Pavia was able to play last year).  Would hope they will not win this one based on other cases and be good for the entire season until the appeal.  NCAA is a joke.

ETA:  the judge was very thorough from what I read on X in her ruling.  Hoping that makes it harder for appellate court to give NCAA a stay.

Where her response falls apart is the 5 in 5 rule change would have the same effect on younger players and lack of roster spots...just delayed a year.  Sure, a higher percentage would not have picked a school yet before knowing the roster limit situation but the squeeze will be the same.

Another solution is allowing these 5th year players  (for this year only) to not count against the roster limit.  problem solved.

Maybe next time they should enact rule changes in a more timely manner.

They are going to continue fighting every loss they get in these cases.  It's really ridiculous because if you read the Indiana judge's ruling, she is VERY thorough in giving her reasons for granting the injunction possibly more so than I have recently seen of others that have won.  They (the NCAA) set themselves up for this when they granted 5 for 5, excluded the 2022 class without a proper argument or documentation in their rulebook, and gave the covid year but excluded others from 5 years.  To me, it really seems like a lost cause on their part but they are going to die on this hill and win whatever stays they can to not allow these 2022 athletes to play this season.  I really think there needs to be a federal court ruling that blankets them all though that they either play or don't.  As how can one state deny the appeal or stay the appeal and another state do the opposite.  Should be fair for one fair for all IMO.  If they went pro, then they don't play.  If they did not go pro and did not sign with any team then they should be able to play.  I don't know what the point the NCAA is fighting because nobody has kicked anyone off their roster in favor of 2022s.

The NCAA constantly appealing these rulings is vastly more annoying to me than LSU trying to roster a couple guys who spent a few weeks in NFL training camps or whatever. There is no meaningful distinction between those guys and Daley and Wyatt IMO. I don't think those guys became superstars because they spent a couple weeks training in the NFL since they were denied an opportunity to play a 5th year like all the classes before them since COVID and all the classes after them will get. The NCAA has gotta go.
