I would adjust that slightly:

  1. They absolutely had a 'legit', statutorily-supported basis to charge.
  2. Whether discretion should have been used is a completely different matter, and I tend to agree with your conclusion on that one.

Good policing for me would have been the officers meeting with the player and his coach, and letting him know that if there was ever another incident like that again he would be charged. Way better than sticking a misdemeanor criminal record on a very frustrated 19 year old who was being taunted by 16,000 people.

I’m a lawyer. It’s not a charge that should be brought, period. You can pull up a criminal statute on almost anything (hey, let’s charge jaywalkers with a crime!). 
You don’t arrest and charge a college kid in a basketball game for spitting, you don’t screw with a kid’s life, with a criminal charge, over something like this. It’s exceptionally stupid, and an absolute abuse of “discretion.” The almost certain result is that no prosecutor will pursue this idiotic charge, but now the kid has an arrest record. Just stupid

I agree.

If law enforcement wants to get communities behind them, they shouldn’t be sticking criminal charges on young people without a damn good reason.

And I’m a lawyer who had a long law enforcement career.

It's really not an either/or situation.

Creighton at Seton Hall (did not start well for Creighton, Seton Hall up 16-3.

San Diego St at Colorado St starting on FS1 in about an hour and a half.....that's one I'll likely tune in to.

Not getting any better for Creighton.  Down 23-5

Okay so I only know a little tiny bit about basketball, but this was something I really noticed this year. They switch a ton, and they’re really using it to their advantage.

Lol Oakland hits a 3 at the buzzer to send it to OT.   Cloverdales own Jalen Moore hits it.   N Kentucky did everything they could at the end to let this happen.   Oakland will win this in OT
