I hope Emmitt Holt and Thomas Bryant take my advice and go to the law library and meet some law students who want to write a bunch of motions for them that Thomas and Emmitt can just take down to the courthouse and file and get this fight going in the right direction.   I wonder if those Excise Cops have a record of racial profiling.   It might possibly be worth the effort to look into the complaints filed against those cops and see if there is a pattern.  Often there is a pattern.   Like it or not, but the state of Indiana has a history of racial profiling.  Sometimes you need to probe into an officer's past and see what's there.  You never know until you look.   Might also be interesting to see where the officers grew up and where they went to school.   And look into a record of their arrests and see if there are patterns there too.   We are much too early in this game to lie down and start apologizing.   Have Bryant and Thomas even been arraigned yet?
  2.   Thank you.   So many people squawking for these guys' heads over this, I just thought I would offer a fresh and useful perspective.
  3.   Please don't take this personally.   I am beginning to question whether you even have a law degree.   Evidence is a 1L course.  And you don't really follow the rules of evidence in your conversation style.   You don't talk like a lawyer.
  4.   But they did not tell you to make a judgment without even having seen the evidence, now did they.
  5.   A bad lawyer makes a judgment without even having seen the evidence, a very bad lawyer.   And a mediocre lawyer goes down without putting up a fight, and just collects a paycheck.   I know a lot of lawyers like that.   Many, many lawyers, just like everybody else, want to do as little as possible, and still collect the full price charged for having actually done a good job.
  6.   Nope.   They should exercise their constitutional rights and prove their innocence.   They are innocent until proven guilty.   You have already convicted them.   I would not want you working on a legal matter of any importance to me.  I would go to you for help, and you would tell me I'm guilty, and that I should apologize.   And then on top of that, how much would you charge me for that service?   Too many random idiots in B'Town calling for their heads to just leave this alone.   Gotta fight it.   And win.   I just unveiled the blueprint.
  7.   Do you have anything more for us than that?   That's not really a very good argument.   Perhaps you suggest they should spend 5 or 6 grand with an overpriced lawyer to fight the case.   Or simply plead guilty to a crime they did not commit because it would take too much time, effort, and/or money to fight using a lawyer.   As students at IU, they have access to one of the best law libraries in the world.   And as IU basketball players, I doubt they would have much trouble enlisting help from hundreds of law students willing to write motions for them.  Bryant and Holt can go down to the courthouse and file the motions themselves.
  8.   I disagree.   If extreme elements of the fanbase are squawking nonstop about kicking guys off the team for this, then I think it would be well worth the time taken to bombard the courthouse with motions, subpoenas, continuances, and force the state to think about how much time, effort, manpower, and money they want to waste on these very small offenses.   I don't think Bryant and Holt should spend a dime.  I think they should go to the law library, check out a few books on beating a minor possession case in the state of Indiana, and do most of the legwork themselves.  Maybe see if they qualify for help from one of the IU legal assistance clinics through the law school, and/or let some IU law students gain some valuable court room experience helping file motions, etc.     No reason to spend money on this.  The object is to make the other side spend the money and make them say "uncle."  Make them think twice about fu*klng with Bryant or Holt again.   Bryant and Holt should be focused on proving the alcohol did not belong to them.  That should be easy enough to do.
  9.   This seems like a fairly easy couple of cases to get tossed.   In minor cases like this, sometimes it is very easy to get the state to expend a ridiculous amount of effort, money, resources on something so meaningless that they finally just drop it because they really only have a limited amount of time, money, etc.   File a bunch of motions, subpoenas, continuances, recesses aimed at causing the other side to spend time, money, manpower, etc.  Create a mountain of paperwork every public official involved in the case must read.  Create as much doubt as possible.  Make those excise cops show up to as many hearings as possible.  If busted at night, schedule a day hearing first.  If they don't show, ask for dismissal because you have the right to cross examination.  If they show, ask for a continuance and schedule for a different time of day.  Claim class schedule for reason for night court continuance.  If busted during the day, schedule a late hearing.  Make them work too hard over this meaningless offense.  Make them cave.   Play to win.

I am not as disappointed in guys having an unopened bottle of vodka in college during Welcome Week than I was with everything that happened last year.   Last year, guys were getting so wasted they were jumping out in front of traffic and their teammates were running over their heads, and other guys on the team were speeding the wrong way down one way streets at oncoming traffic at blackout level buzz.   This is not even close to a 'throw them off the team and fire crean and glass' level offense imo.   It's college.

    I prefer letting Terry pick the content he wants to work with here.  He's a proven commodity, and he is not just good at what he does, he is great at it.  Why fool with that?   ccgeneral seems to have the recruiting down, and has been one of the best in the biz since long before he even became officially associated with any site, and he also has some other guys working with him here who are really good too, and Hutch is adding another guy too if I read the Hutch welcome letter correctly.

    Oh he11 yes!   Nice coup.   Good job, BTownBanners and Hutch!   This could be a great move for all involved.   I am sure everybody involved feels a great sense of accomplishment, but 41 must be in a very happy place right now, and deservedly so.   Hard work and determination generally pay off in this life.  That is a principle we can still usually count on.  Slow and Steady wins the race.   Pretty amazing remembering this site before The Movement for lack of a better term.  But for lack of a better term, that term seems perfectly appropriate.
